Conclusion of Contract

Between the seller and the buyer.

The product descriptions contained in EL MORA do not constitute binding offers by ELMORA; they serve only to submit a binding offer by the purchaser.

Order processing and communication usually take place via email and automated order processing. Invoices are issued exclusively in Euro. The goods include the respective VAT, including payment/delivery.

The following options are available to you: Advance payment, Purchase on invoice (after credit check), Credit card, and Cash on delivery.

Explanation:

1. Payment by invoice (after credit check): Goods are sent with the invoice. Payment deadline: Immediately upon receipt of the goods, but no later than 7 days. EL MORA reserves the right not to send the goods by invoice. In case of default in payment, the customer bears reminder fees and default interest at a rate of 7%.
2. For advance payment, the invoice will be sent to you by email in advance, and after payment, the goods will be shipped within 1-2 working days. For orders below the defined order value, packaging and shipping costs are individually calculated. Shipping costs are charged according to value and freight. Shipping costs for third countries are also calculated individually. Delivery is made by post, DPD, or DHL. In some cases, also with UPS or a freight forwarder.

Revocation Policy

Consumers have a right of revocation according to the following provision, whereby consumers are any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity:

The revocation period is 14 days. To exercise this right of revocation, you must inform EL MORA, Wallerseestr.74o, 5201 Seekirchen am See, Austria, Tel +43 0664-1022073, email morasch@morasch.eu, as a customer by post or email of your decision to revoke this contract.

In case of revocation of the contract, payments made to us will be refunded (after receipt of the goods).

As a customer, you bear the direct costs of returning the goods.

Warranty

If the product is defective, the provisions of statutory warranty apply.

The customer has the right to subsequent performance, but claims are generally excluded for used goods.

Liability

The seller shall be liable to the customer for all contractual, quasi-contractual, and legal claims for damages and reimbursement of expenses as follows:

The seller shall be liable without limitation on any legal grounds in cases of intent or gross negligence according to the Product Liability Act.

Applicable Law

For all legal relationships between the parties, the law of the Republic of Austria applies.
